Program Eligibility

In order for your company to qualify for coverage, you must be under contract with the federal government at the time of applying for a policy. This includes contractors for the DoD, GSA, NASA, and other federal and state agencies; universities and research institutions that accept federal grants; consulting firms with federal contracts; manufacturers who supply goods to federal agencies and service organizations that provide services to federal agencies as well as the subcontractors of those organizations. Your contract can be as a sub to a prime or a prime in support of either or both the Department of Defense or non-DOD federal organizations. The cost of the cyber insurance plans and data breach support programs may be reimbursable by the government as Security Assistance expense. All civilian non-DOD contractors must comply with the Federal Acquisition Regulation (FAR) clause, part 52.204-21, which defines a set of cyber security measures to help ensure basic safeguarding of federal contract information that is processed, stored, or transmitted by contractor systems. The FAR clause includes a flow down provision, which means the requirements apply not only to the contractor, but also to all of its subcontractors and suppliers. A contractor can be held financially liable for the actions of sub-contractors in the event of a data breach.
